This website is owned and operated by Versus Systems SA. References to “we/us/our/Versus” throughout this Privacy Policy mean Versus Systems SA, registered with the Commercial Register in Geneva (register Nr. IDE CHE-101.758.732) and located at 1, rue Cornavin, 1201 Geneva, Switzerland.

Versus is a publisher that designs and distributes talent assessment and profiling solutions. We are committed to the protection of the privacy and personal data of everyone who visits our website, purchases our products and services, or uses our assessment solutions. We will only collect and use information in ways that are useful to you and in a manner consistent with your rights and our obligations under the law.

​Please review this Privacy Policy (“Policy”) carefully and ensure that you understand it. Your acceptance of our Policy is deemed to occur upon your first use of versusprofile.com. If you do not accept and agree with this Policy, you must immediately stop using our website, products and services.

​Versus also partners with third-party coaches, facilitators and trainers (“Partners”) who may provide personalised debriefing. The Versus Policy does not apply to the services of Partners. Please refer and accept the privacy policy of our Partner if you use their services.

PURPOSE
In this Policy we explain what personal data we collect and why, as well as how we process the data. We also explain how you can verify, correct or remove your personal information if you so wish.

​When collecting data, we act in accordance with Swiss data protection laws and the European Union (“EU”) General Data Protection Regulation (“GDPR”) where we are responsible as “Controller” of that personal information. We may also provide you with additional information at the time we collect your personal information where we feel it would be helpful to provide relevant and timely information.

For the purposes of EU law, Versus Systems SA is the Data Controller and has appointed Rolf Roethlisberger as our Data Officer.

The term “User” means, in the case of this Policy, any visitor or user of versusprofile.com, any client or partner beneficiary of our assessment services or any legal representative acting on behalf of a client, as well as any participant invited to take a Versus assessment.

​The term “Client” means a person or organisation who has purchased one or more of our assessment products.

The term “Participant” means an individual who is completing one or more of our assessment products.

​”Versus Services” refers to website features and other services provided to you when you use versusprofile.com, Versus products or services, or applications or software provided by Versus in connection with any of the foregoing.

WHO IS IN CHARGE OF THE DATA COLLECTION?
Versus is in charge of collecting your personal data.

When a Client uses Versus Services as an “Assessor” by asking someone else to complete a Versus assessment/test as a Participant (referred to also as an “Assessee” in this case), the Client also becomes responsible for processing personal data provided by the Participant, and therefore, agrees to abide by this Privacy Policy and the applicable data protection legislation.

WHAT IS THE PERSONAL DATA THAT WE COLLECT?
Versus collects only the data needed to provide and to optimise your User experience and Versus Services.

The collection of your personal data can be carried out in two ways:

  • Directly, when you freely communicate your personal data to us;
  • Automatically via technology used on our website and applications.

​We collect the following types of personal data when you provide it to us: First and last names, company, position and/or profession, email address, phone number, geographic location (city, country) or address, Participant gender, size of business and/or assessment volume you use for your business purposes, email addresses of Assessees linked to Client purchases, Client payment details, Client purchase history, Participant responses to assessment questionnaires, communications such as inquiries or feedback sent to us, responses to our marketing surveys, User communication and language preferences, and records of User consent to our policies and terms of use.

In addition, when you use Versus Services, we collect the internet protocol (IP) address used to connect your computer to the internet and other non-identifying personal information about your computer and internet connection, such as device type and operating system. We also use software tools to measure and collect information about the use and performance of Versus Services, such as website session data, page response times, page visits, duration of visits, page interactions, and referring/exit pages. ​

We collect your information when you:

  • Contact our customer service or ask to be contacted by a Versus representative;
  • Browse VersusProfile.com and use Versus Services;
  • Request a product demonstration or a quotation, or submit a contact form on versusprofile.com;
  • Place an order, make a purchase, complete an assessment, or are invited to take an assessment and benefit from an assessment report;
  • Register as a Versus Partner, apply for Partner certification or request a referral to one of our Partners;
  • Participate in a marketing survey to help us improve our products or services.

Some of the information we collect is automatically collected via cookies and other similar technologies (“Cookies”). You may read our Cookie Policy for more information about our use of Cookies and how you can exercise control over them.

​Please note that we do not change our data collection practices in response to a “Do Not Track” signal in the HTTP header from a browser or mobile application, however, most browsers allow you to control Cookies, including whether or not to accept them and how to remove them. You may set most browsers to notify you if you receive a Cookie, or you may choose to block Cookies with your browser.

​Versus does not knowingly collect data from children under 16 (sixteen) years of age. In order to use Versus Services, you must be at least 16 years of age, or above the legal age threshold where parental consent is no longer required in your jurisdiction. You are not allowed to use this website and Versus Services if doing so is prohibited in your country or under any law or regulation applicable to you. Versus reserves the right to refuse service, terminate accounts, terminate your rights to use Versus Services or cancel orders in its sole discretion.

FOR WHAT PURPOSES IS YOUR DATA COLLECTED?
Data you provide to us is used for the purpose indicated at the time of data collection. Versus collects your personal data for the following purposes:​

  • To respond to your inquiries or requests;
  • To optimise your experience of VersusProfile.com, its functionalities and services;
  • To provide you with customer service and product support;
  • To process payment for purchases, and for Client account management and accounting purposes;
  • To provide you and/or your Assessees access to assessment questionnaires and reports;
  • To perform the assessment completed by you and/or your Assessees;
  • To send you relevant Client and Partner newsletters or notices with Versus company, product or promotional updates and information;
  • To conduct surveys to get your opinion or feedback on Versus Services or prospective products/services;
  • To share with our authorised Partners when you have submitted a request to find a Versus Partner;
  • To fulfil our legal and regulatory obligations;
  • To enhance our data security and fraud prevention capabilities;
  • To analyse the performance and effectiveness of Versus Services and marketing activities.

​We may also use your personal data to contact you to notify you regarding any questions or issues around your purchase or use of Versus assessment solutions, to troubleshoot any issue you encounter with Versus Services, to resolve a dispute, to collect fees or monies owed or as otherwise necessary to contact you to enforce our terms and policies, applicable laws, or any agreement we may have with you. For these purposes we may contact you via email, telephone, text messages, or postal mail, depending on the contact information you have provided to us and any communication preferences you have indicated.

HOW DO WE ENSURE THE SAFETY OF YOUR DATA?
We implement security measures designed to protect the personal data you share with us to prevent alteration, loss of or unauthorised access to your data on our servers. These encompass organisational and technical measures, including encryption and anonymization of assessment data. We limit access to your personal assessment data to those who have a genuine business need and our personnel are subject to a duty of confidentiality. We carefully select third-party service providers to ensure they implement security measures to protect your personal data.

Nevertheless, regardless of the measures and efforts taken by us and our service providers, we cannot and do not guarantee the absolute protection and security of your personal data. There are no guarantees that a data transmission or storage system is completely secure, and although we do our best to protect your personal data, you should be aware that the transmission of your personal data to us via the internet is at your own risk. For this reason, we encourage you to avoid providing us with any sensitive personal information of which you believe its disclosure could cause you substantial or irreparable harm. WITH WHOM ARE WE LIKELY TO SHARE YOUR DATA?
The access to your personal data is limited to:

  • Versus, and
  • Authorised third parties: They will access and process your data only within the limits required for achieving the tasks they were given. Authorised third parties can be:Data processors, sub-processors, or other service providers (including their employees) of Versus;
  • A Client when you have agreed to participate in an assessment as an Assessee of the Client;
  • A Partner when you have submitted a request to us to find a Versus Partner;
  • Ministerial, judicial or administrative authorities, exclusively to meet legal obligations.

When sharing your personal data with such third parties, we strictly require that the personal data is used only for the purposes authorised and in accordance with our Privacy Policy, and that third parties always act in accordance with applicable laws regarding the protection of your personal data.

​Our website is hosted on the Infomaniak.com platform. Infomaniak.com is a third-party service provider and data processor that provides the online platform for our versusprofile.com website. Your personal data collected through versusprofile.com is processed by Infomaniak.com and may be stored through Infomaniak.com data storage, databases and the general Infomaniak.com applications. Infomaniak.com implements physical, electronic and procedural measures to protect personal data including storing your personal data on secure servers behind a firewall.

ANONYMOUS DATA SHARING
We may share anonymous data (not personally identifiable) with third-party collaborators such as research groups, academics, or related institutes solely for statistical purposes and validation of our assessment questionnaires. This data will not allow anyone to identify you.

HOW LONG DO WE KEEP YOUR DATA?
We will keep your personal data for the duration of our business relationship and to the extent permitted or required under applicable law, after termination of the business relationship. Laws may require Versus to hold certain information for specified periods. In other cases, Versus may retain data for an appropriate period after the business relationship ends to comply with its legal obligations, to meet regulatory requirements or to protect itself from legal claims. In relation to other personal information collected, it will be deleted as soon as the purpose for which it was collected ceases or the information is no longer needed for that purpose.

However, Versus reserves the right to retain all or part of the data collected, in particular for statistical purposes, anonymously (without personally identifiable data, such as the first, last name, Participant ID or email address).

Concerning the assessment process of Participants: Versus will keep the results of past assessments for a period of 3 months. The Client agrees not to export and retain Participants’ data (the data of their Assessees) beyond the purposes for which the data was collected, to comply with local requirements in their country, and to anonymise after a certain period of time the Participants’/Assessees’ data received from Versus.

WHAT ARE YOUR RIGHTS REGARDING YOUR PERSONAL DATA?
You have the right to access, rectify and delete your personal data, as well as the right to limit the processing and the portability of your data. You can exercise these rights at any time by contacting our customer service by email at: rgpd@myversus.com.

Note for Participants who are also Assessees: The request for deletion of Participant personal data in the context of an evaluation conducted by a Client who is acting as an Assessor must also be sent directly to the Client/Mandatary (the person who invited the Participant/Assessee to take the Verses assessment/test), who will delete the data concerned.

WHAT DO WE EXPECT FROM YOU?
You must ensure that the information you provide to us is relevant and up-to-date.

​If you provide us with information about a third party, you must ensure that you are authorised to do so.

INTERNATIONAL DATA TRANSFERS
Prior to transfer of personal data outside the European Union or any international transfer of personal data, Versus or our third-party processors are implementing measures for the protection and security of such transfers. By using our website and Versus Services, you consent to such transfer of personal data outside your country of residence and/or the European Union if necessary for us to provide Versus Services.

THIRD-PARTY WEBSITES
Our website may contain links to and from the websites of our Partners and other companies. It is important to note that these websites are not operated by Versus and have their own terms of use and privacy policies. Social media features used on our website, such as buttons for LinkedIn, Facebook and Twitter, may enable the providers of those features to collect information about you when you use them. By using such third-party features, you consent to your information being shared with those providers and you are subject to the privacy policies published on the website of the company that provides the feature. We do not accept any responsibility or liability for third-party websites or their privacy policies. Please check these policies before you submit any personal information to these websites or use their features.

MODIFICATIONS AND AGREEMENT
Versus reserves the right to modify this Policy at any moment, entirely or partially. These modifications will come into effect starting from the publication of the new Policy. By using our versusprofile.com website and Versus’ Services, you express your agreement to this Privacy Policy.
